Terms & Conditions

To join the Garmswap community and to lend, borrow and swap items on Garmswap you must first accept our terms and conditions. These terms and conditions are set up to protect Garmswap members and to build trust on the platform.

Your data: The personal information collected from you in the sign up process is so that we can contact you in relation to the Garmswap service and the Garmswap community. In the event that you are lending, borrowing or swapping a piece we may share this information with the borrower/lender/receiver in order to arrange the borrow or swap.

Definition of Lender: A lender is someone who shares their clothes with other Garmswap members. This share is for a limited time period and there is no monetary payment given to the lender for this.  

Definition of Borrower: A borrower is someone who loans an item from a lender for a limited time period.

Definition of Swapper: A swapper is someone who permanently swaps an item with the receiver of the swap (swappee).

Definition of Swappee: A swappee is someone who receives a permanent swap from the sender (swapper).

Definition of Token: Tokens are swap tokens which users receive in exchange for pieces they list on the Garmswap app.  A silver or gold token is awarded to the piece based on its condition and_cc781905-5cde-3194 -bb3b-136bad5cf58d_ current retail value market.

Lender: When you upload your item please tell us the current value of your piece (taking in to consideration how old this is and how many times it has been worn). Accurately describe you piece and note any flaws or areas of slight damage. Specify how the piece should be cleaned. You will accept these terms and conditions when you first sign up to the platform.

Borrower: When borrowing a piece you agree to take care of the piece you are borrowing. In the event that a piece is damaged or lost, is not cleaned using the stated method, or is not returned by the specified dates (unless alternative arrangements are made) you will pay back to the lender the current value of the item. Garmswap will give the borrower 7 days notice before the money is removed from the borrower's account. You will accept these terms and conditions in the checkout section when you are requesting to borrow a piece.

Swapper: When you swap a piece permanently, you agree that the piece is as described in the upload, it equals the current retail value and you are legally able to offer this piece to swap.

Swappee: Responsible to ensure the piece received is as described by the swapper and if not to report this to the sender.

Tokens: For indicative purposes only in exchange for the current retail value of a piece listed on the app by a sender. Cannot be exchanged for money.

Full terms & conditions

1) Access to Personal Contact Details

By signing up to Garmswap, permission is given to Garmswap to contact me in relation to Garmswap services using the personal details that I have shared, and to share my personal email address and mobile number provided with

(i) The lender of a piece that you are borrowing

(ii) The borrower of a piece that you are lending

(iii) The sender of a piece you are swapping

(iii) The receiver of a piece you are swapping

so that lender, borrower, swapper and swappee can contact each other to arrange shares and swaps.

I acknowledge that I can remove my data and information from the Garmswap platform at any time by contacting info@theGarmswapardrobe.com and requesting this, and that Garmswap can provide me with all of my recorded data within 30 days of a request for access to my date.

 

2) Personal responsibility on the platform

These terms and conditions outline an agreement between borrower and lender, swapper and swapee,  Garmswap is not a party to the agreement when sharing and swapping clothes and the borrower/ lender_cc781905-5cde-3194-bb3b- 136bad5cf58d_ and swapper/swappee are solely responsible for any loss or damage done to any item.

 

3)Platform usage and safety

I acknowledge that when uploading images and information to my public profile that these images and information are available on the world wide web. Before uploading anything please consider what kind of images and information you would like to share.

I acknowledge that if I feel unsafe or intimidated on the Garmswap platform that I will report this immediately to the Garmswap team.

 

4) Code of conduct

I agree that as a member of the Garmswap Community I will respect all members on the platform and will not take part in any activity that bullies another member in any way.

I acknowledge that if there are accusations of bullying made against me that my account will be suspended and the matter will be reported to the police.

I acknowledge if it is found that I have used Garmswap as a platform to bully another member that I will be immediately removed from the platform.

5) Tracking and optimization

By signing up to Garmswap permission is given to Garmswap to use Facebook pixels, Google Analytics, and Hotjar (website analytics and feedback tool) to track conversions on the platform and optimize our platform processes.

Terms and Conditions when lending a piece:

1.Garmswap's Role in the Contract

Garmswap is a service for facilitating borrowing and lending between sharers, Garmswap is therefore not responsible for any loss or damage done to any item.  Garmswap is not a party to the contract of agreement.

2.Uploading and description of lending items

(i) I confirm that the images provided by me and description is a true reflection of the condition of the item(s) and I am sharing on the Garmswap platform.

(ii) I confirm that the 'item' value stated is genuine and is accordingly adjusted to reflect the age of the garment and the amount of times it has been worn.

(iii) For each item I upload I have provided information on the compensation

I expect to be paid by the lender should the item be damaged or not returned by the lender. The item value stated is reflective of the item's current value rather than retail value and takes into account the age of the item and the amount of times it has been worn.

3.Damage/Loss of an Item

Lenders acknowledge that the items being shared may be damaged or lost, if this is the case the total of the value stated on the site for the item is the maximum sum that can be retrieved. In the event of damage/loss of an item, it is my duty to ensure the collection of this sum from the specific borrower. Garmswap is not responsible for any non-compliance of the borrower in relation to the collection of this sum. Garmswap is not liable for the sum of the value of the item.

4.Procedure for reimbursement in case of damage/loss:  

(i) Before rental the Borrower will be informed on the platform the date  of return, the requirements of washing, and the location the item must be returned to. If these conditions are not met and if the garment is in unsatisfactory condition an amount equivalent to the value of the product shall be taken from the borrower's account.

(ii) If damaged, the lender must prove that the garment is in an unsatisfactory state by providing pictures of the piece to the Garmswap team.

(iii) Garmswap will arrange charge the borrower for compensation to either repair the item or the current item value (as specified on the website).  

(iv) The borrower will receive 7 days notice before the money is taken from their account through the Stripe payment system.

(v) Once Garmswap has confirmed with the lender that they will be compensated the lender will be paid immediately by Garmswap and Garmswap will receive payment from the borrower. This will usually be the defined sum taken directly from the borrower's stripe account or, at the discretion of Garmswap may be made on a case by case basis can in installments.

5.Access to Personal Contact Details

By signing up to Garmswap permission is given to Garmswap to contact me in relation to Garmswap using the personal details that I have shared and to share the personal email address and mobile number  provided with the lender so that both lender and borrower can contact each other to arrange shares.

 

Terms and conditions when borrowing a piece:

1.Garmswap's role in agreement

Garmswap is a service which facilitating borrowing and lending between sharers, Garmswap is therefore not responsible for any loss or damage done to any item.  Garmswap is not a party to the contract of agreement.

2. Borrower's Responsibilities

(i) the borrower of the item has the responsibility to wash (in the appropriate manner, as specified on the item label and as the lender has outlined on the item specifications) the item borrowed.

(ii) the borrower has the obligation to return the item to the lender within the time indicated on the item checkout.

3.Responsibility for Loss/ Damage of Item:

If I lose or damage an item, I will be obliged to pay the current value of the item (as indicated on the item at checkout) to the lender.

4.Procedure for reimbursement in case of damage/loss:

This will be the defined sum for repairs/ replacement taken directly from the borrower's stripe account or, at the discretion of The Nu Wardrobe may be made on a case by case basis can in installments.

Terms and conditions when swapping:

1.Garmswap's role in agreement

Garmswap is a service which facilitates swapping between users, Garmswap is therefore not responsible for any loss or damage done to any item.  Garmswap is not a party to the contract of agreement.

2.Swappers responsibilities

(i) Images and description provided are a true reflection of the condition of the item(s) being shared on the Garmswap platform.

(ii) Current retail value stated is genuine and is accordingly adjusted to reflect the age of the garment and the amount of times it has been worn.

(iii) The item can be legally offered to swap.

(iii) If the item is found to be misdescribed or not to guidelines, the cost of returning the item from the receiver falls on the sender.

3.Swappees responsibilities 

(i) If the piece is not as described upon exchange, the swapper must be contacted and made aware of the issue.  The swappee must prove the piece is not as described, providing imagery where necessary to Garmswap.  

(ii) If it is the case that the claim is correct, the swappee will be reimbursed with the equivalent token.  The swapper will be responsible for the cost of returning the item.

4.Tokens

(i) Tokens are for indicative purposes only and cannot be exchanged for money. 

(ii) Garmswap reserves the right not to award tokens for items even if initially approved. Although you may appeal any evaluation, our decision is final.

(iii) Garmswap has the authority to cancel tokens for any reason effective upon sending notice to you at the email address you provide whilst registering or such other email address as you may later provide to us.

(iii) If an item is initially approved and awarded a token but then subsequently removed from the Garmswap app, the swapper will be deducted the value of this token.

(v) If your membership is terminated, you are not entitled to any tokens incurred.
